These Terms & Conditions apply to the BuildRank Studio website and freelance services provided by Sumit Tyagi. BuildRank Studio is a freelance trading name and is not presented as a registered company.
1. Project requests are not automatic orders
Submitting the Start a Project form is a request for review and quotation. It does not require you to make a payment and does not require BuildRank Studio to accept the project.
2. Scope and quotation
Before work begins, the project requirements, agreed deliverables, price and expected timeframe will be confirmed. A quotation may include additional project-specific terms. If a quotation conflicts with a general term on this page, the project-specific written agreement will normally govern that project to the extent permitted by law.
3. Payment
Unless agreed otherwise in writing, 100% of the quoted project price is due before work begins. Payments are generally made by Australian bank transfer using the payment details supplied with the accepted quotation. Bank charges, exchange charges or other transfer costs charged to the client are the client’s responsibility.
4. When work starts
Work starts only after the required project details have been finalised, the scope and timeframe have been agreed and full payment has been received. A preferred date submitted through the website is not a confirmed deadline until it is accepted in writing.
5. Client responsibilities
The client is responsible for providing accurate requirements, approvals, content, credentials, files, access and other information reasonably needed to complete the work. Delays in providing these items may move the project schedule.
6. Revisions
Unlimited revisions are available within the agreed project scope. A revision is an adjustment to an agreed deliverable. A new feature, new page, new design direction, material change in requirements, additional integration or other work outside the original scope is not treated as an unlimited revision and may require a revised quote.
7. Third-party products and costs
Unless a quotation expressly states otherwise, the client is responsible for domains, hosting, premium themes or plugins, paid APIs, stock assets, third-party services, software subscriptions and other external costs. Third-party products remain subject to their own licences, terms, availability and support policies.
8. Ownership and handover
After the agreed custom work has been completed and the project has been fully paid, the client receives ownership and control of the custom deliverables created specifically for that client, subject to any third-party licences, open-source licences or pre-existing tools incorporated into the work. BuildRank Studio does not retain website control simply to require ongoing maintenance.
9. Freelancer delivery
The services sold through BuildRank Studio are performed by Sumit Tyagi as an independent freelancer. BuildRank Studio does not represent that it has an internal agency team and does not routinely pass client work to another freelancer as a hidden subcontractor.
10. Maintenance and ongoing support
Ongoing maintenance is not automatically included after project completion unless it is part of the accepted quotation. Monthly maintenance or further development can be quoted separately.
11. Project inactivity
If the client does not respond or provide required information for 30 consecutive days, the project may be treated as inactive. Resuming an inactive project may require a revised schedule depending on current workload and any changes to the technical environment or original requirements.
12. SEO and results
SEO, website development and related services can improve technical quality, relevance, usability and search readiness, but BuildRank Studio does not guarantee rankings, traffic, leads, enquiries, sales, revenue, search-engine inclusion or any other outcome that depends on third parties, algorithms, competition, market conditions or visitor behaviour.
13. Existing systems and third-party changes
Existing websites, hosting platforms, plugins, themes, APIs and third-party services can contain faults or change independently. Where work depends on an existing or third-party system, BuildRank Studio is not responsible for failures caused solely by systems outside reasonable control, but relevant issues discovered during the agreed work will be communicated.
14. Cancellation and refunds
A payment may be refunded if the project is cancelled before work has started. Once work has started, payments are generally non-refundable because time and capacity have been committed to the project, subject always to any rights or remedies that cannot legally be excluded. 15. Liability
To the maximum extent permitted by law, BuildRank Studio is not liable for indirect, incidental or consequential losses arising from use of the website or services, including loss of profit, business opportunity or data caused by matters outside reasonable control. Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded or restricted, including mandatory consumer protections where they apply.
16. Australian clients
Where Australian consumer law or another mandatory Australian law applies to a particular client or service, these terms are intended to operate subject to those non-excludable rights. Nothing on this website is intended to remove rights that the law does not allow a service provider to exclude.
17. Governing law
Except where mandatory law requires otherwise, these terms and freelance services are governed by the laws applicable in Uttar Pradesh, India. Any mandatory consumer rights that apply in the client’s jurisdiction remain unaffected to the extent required by law.
